On Thursday, May 23, 2002, at 1115 hours, Deputies Milburn and Wolf were dispatched to a disturbance at 532 Apt.T-4 Daytona Parkway, Harrison Township. At approximately 1145 hours, while Deputy Wolf and Deputy Milburn were investigating the disturbance, Ms. Pamela Thomas arrived at the scene. Ms. Thomas's daughter, Tamara Thomas, was being detained in the backseat of Deputy Millburn's marked cruiser. Ms. Thomas approached Deputy Milburn's cruiser and Deputy Wolf instructed her to step way from the vehicle. Ms. Thomas alleges that when Deputy Wolf spoke to her he abused his position by attempting to intimidate her and treated her in a cruel and inappropriate manner.
